These Terms of Use (the "Terms") govern your access to and use of the Nous CRM website (the "Site") and the Nous CRM service (the "Service"). By accessing or using the Site or the Service, you agree to be bound by these Terms.

  • "Customer Data" means any data,
  • file attachments, text, images, reports, personal information, or any
  • other content, that is uploaded or submitted, transmitted or otherwise
  • made available, to or through the Service by you or any User and is
  • processed by us on Customer's behalf.
  • "Authorized Users" means any
  • users of the Service, including guests, viewers, and team members, who are
  • authorized to access and use the Service by the Customer.
  • "Customer" means the entity
  • that has purchased a subscription to the Service.
  • "Nous CRM" means The Trustee for the Bakshi Family Trust (ABN # 89356201456), the company that provides the Service.
  • "Service" means the Nous CRM
  • service, which includes the Site and the software that enables you to
  • create and manage your customer relationships.
  • "Terms" means these Terms of Use.

3. Your Customer Data

  • You are responsible for the accuracy, quality, and legality of all Customer Data that you upload or submit to the Service.
  • Nous CRM will not sell or share your Customer Data with third parties without your consent, except as necessary to provide the Service to you.
  • Nous CRM may use your Customer Data to improve the Service and to provide you with marketing and promotional materials.
  • You have the right to access, correct, and delete your Customer Data at any time.

4. Your Use of the Service

  • You may use the Service only for lawful purposes.
  • You may not use the Service to infringe the copyright, trademark, or other intellectual property rights of others.
  • You may not use the Service to send spam or other unsolicited messages.
  • You may not use the Service to harm or attempt to harm Nous CRM or any other person or entity.

5. Nous CRM's Rights

  • Nous CRM reserves the right to modify or discontinue the Service at any time.
  • Nous CRM reserves the right to terminate your access to the Service for any reason, including if you violate these Terms.

6. Your Liability

  • You are responsible for any and all claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of the Service.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.

8. Entire Agreement

These Terms constitute the entire agreement between you and Nous CRM with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

9. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.


10. Waiver

No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.

11. Notices

All notices and other communications hereunder will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in Australia mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

The address provided by the Customer in its account registration information.

or to such other address as either party may designate in writing from time to time.


12. Headings

The headings in these Terms are for convenience only and will not affect their interpretation.


13. Counterparts

These Terms may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.


14. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Victoria, Australia.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in accordance with the Victorian State Law, Australia.
